Please note that the Motiv8 Terms and Conditions can only be amended in writing by Motiv8. These Terms and Conditions are effective as of August 13, 2024, and supersede all previous versions. Motiv8 reserves the right to modify or update these Terms and Conditions, as well as any associated participating brands, at its sole discretion and without prior notice.
GENERAL
“Motiv8” refers to Denaster LLC, the entity with ultimate responsibility for the Motiv8 loyalty programme, or any other companies within the same corporate group.
“Motiv8 Programme” or “Programme” refers to the loyalty programme owned and managed by Motiv8.
“Member” or “Members” refers to any individual who has registered for the Motiv8 Programme, and “Membership” shall be construed accordingly.
“Mpoints” refers to the currency of the Motiv8 loyalty programme, which is accrued based on spend in United Arab Emirates Dirhams (AED). This is reflected as a Points Balance available to the member for “Redemptions.”
“Redeem” or “Redeeming” refers to the process by which a member exchanges Mpoints for a “Reward” or “Rewards.”
“Reward” or “Rewards” refers to eligible products provided by Motiv8 to a member in exchange for Mpoints.
“Participating Brands” refers to the brands under the Motiv8 Programme that allow members to earn or redeem Mpoints.
“Eligible Activity” refers to a transaction that qualifies for earning or redeeming Mpoints.
“Programme Website” refers to the official website of the Motiv8 loyalty programme, located at www.motiv8.ae.
“Eligible Spend” refers to the total spend after the deduction of taxes, service charges, or any other ineligible spend as specified below, at Participating Brands, following the processing of payment.
“Privacy Policy” refers to the policies and practices governing the collection, use, maintenance, protection, and disclosure of information that Motiv8 may collect from its members.
Terms and Conditions
Governing Law and Jurisdiction
The Motiv8 “Terms and Conditions” are governed by and shall be construed in accordance with the laws of Dubai, United Arab Emirates (UAE). Any claims or disputes arising out of or in connection with the Programme shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE. Class actions or other collective legal actions are not permitted.
Legal Compliance
Membership in, and application for membership to, the Motiv8 Programme is void where prohibited by law in the Member’s or applicant’s country of domicile.
Programme Termination
The Programme has no predetermined termination date and may continue until Motiv8 decides to terminate the Programme. Motiv8 reserves the right to terminate the Programme at any time, with or without notice. Upon announcement of Programme termination, Members will have three (3) months to accumulate Mpoints and redeem desired Rewards. After this period, all rights to accumulate Mpoints and claim Rewards shall cease.
Amendments to the Programme
Motiv8 reserves the right to add, modify, limit, delete, or otherwise change any rules, procedures, conditions, and “Earn” and “Redeem” criteria related to the Programme at its sole discretion, with or without notice. Changes may affect the value of Mpoints already accumulated by Members, and Motiv8 may make such changes affecting, but not limited to, Participating Brands.
Eligibility for Membership
Only individuals aged 18 years and above, or those who have reached the age of majority in their state or country of residence, may enroll in the Programme. Corporations, associations, or groups are not eligible to enroll.
Membership Rights and Obligations
Programme membership entitles Members to earn Mpoints, which may be redeemed for Rewards in accordance with these Terms and Conditions. Member Benefits and Rewards may not be available where prohibited by law or regulation in the Member’s country of residence.
Prohibition on Multiple Accounts
Members are prohibited from maintaining multiple membership accounts or earning and redeeming Mpoints across different accounts.
Termination of Membership
Motiv8 reserves the right to discontinue the membership of any Member who appears to be using the Programme inconsistently with its Terms and Conditions or intent, including but not limited to the earning and redemption of Mpoints and the use of Benefits. Motiv8 may also terminate membership if a Member violates local or federal laws or if there are reasonable grounds to suspect fraud, theft, or dishonesty. Termination of membership may result in the forfeiture of all accumulated Mpoints. In addition to discontinuing membership, Motiv8 may take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary.
Prohibition on Sale or Transfer of Mpoints
The sale or barter of Mpoints or other Benefits by any party other than Motiv8 is strictly prohibited. Any Mpoints or Benefits that Motiv8 determines, at its sole discretion, to have been transferred, sold, or assigned in violation of these Terms and Conditions may be confiscated or canceled.
Interpretation of Terms and Conditions
All interpretations of these Terms and Conditions shall be made at the sole discretion of Motiv8.
Account Activity and Mpoints Forfeiture
Members who do not engage in “Eligible Activity” as defined, within a consecutive twenty-four (24) month period, may be removed from the Programme and may forfeit all remaining Mpoints. To retain accumulated Mpoints, Members must either:
Earn Mpoints through the Motiv8 Portfolio;
Redeem Mpoints from the Motiv8 Portfolio;
Earn Mpoints through any qualifying Participating Brands;
Redeem Mpoints through any qualifying Participating Brands.
Once Mpoints are forfeited, they cannot be reinstated, but the Member may begin earning Mpoints anew. Rewards redeemed before forfeiture remain valid.
Member Responsibilities
Each Member is responsible for staying informed about the Terms and Conditions and the number of Mpoints in their account. While Motiv8 may attempt to notify Members of significant matters, including Mpoints forfeiture or Programme changes, it is not obligated to do so. Neither Motiv8, Participating Brands, nor third-party partners shall be liable for any failure to provide such notice.
Account Security
Members are responsible for creating and maintaining the security of their account access information. Motiv8 shall not be liable for unauthorized access to a Member’s account, the accumulation of Mpoints, redemption of Rewards, or any other account activity resulting from such unauthorized access. In the event of suspected fraudulent activity, including unauthorized redemption of Mpoints or Rewards, the Member must report the activity to Motiv8 in writing within thirty (30) days of its occurrence. Motiv8 may, at its sole discretion, reinstate lost Mpoints or Rewards.
Updating Member Information
Members are responsible for notifying Motiv8 of any changes to their contact information. If a Member changes their name, they must send an email to customerservice@motiv8.com with proof of the name change, such as a valid passport, Emirates ID, or marriage certificate, along with a signed letter. Motiv8 handles all personal details with utmost confidentiality and does not share them. Members are advised to review the Privacy Policy for more information.
Non-Transferability of Mpoints
Accrued Mpoints do not constitute property of the Member and are not transferable, except as specifically provided in these Terms and Conditions.
Member Benefits and Services
Specific Benefits and services are established for all Members. However, Motiv8 is not responsible for any changes or discontinuance of services or products by Participating Brands that may affect the availability of Rewards or the accrual of Mpoints.
Relationship with Partners
Nothing in these Terms and Conditions shall be construed to create or establish any agency, partnership, or joint venture relationship between Motiv8 and its partners.
Transfer of Mpoints Upon Death
In the event of a Member’s death, Mpoints in the deceased Member’s account may be transferred to another active Member upon Motiv8’s receipt and approval of certain documentation, including a valid death certificate. Requests for transfers must be made in writing within one (1) year of the Member’s death. The transfer of Mpoints remains at Motiv8’s sole discretion, and any decision is final and not subject to dispute. In case of any dispute, UAE law will apply.
These Terms and Conditions constitute the entire agreement between the Member and Motiv8 concerning the Programme and supersede all prior agreements, representations, and understandings. Motiv8 reserves the right to amend or update these Terms and Conditions at any time, with or without notice.
ACCRUAL OF UPOINTS
Mpoints can be earned at participating brand attractions within the Motiv8 Portfolio and Motiv8 loyalty programme. Participating brands within the Motiv8 Portfolio and Motiv8 loyalty programme are subject to change at any time, without notice. For a full listing of participating brands, visit the “Programme Website”. If a participating brand ceases to be a participating brand within the Motiv8 Portfolio, all “Eligible Spend” subsequent to such date can be used towards the other brands.
Mpoints can only be earned at the Programme participating brands and cannot be earned at external partners.
When shopping Mpoints can be earned at all Motiv8 existing outlets & e-commerce website – www.motiv8.ae only.
A valid receipt is defined as a store receipt for a transaction carried out by a member at any of the Motiv8 outlets and website and submitted within 14 days from the transaction date through the Motiv8 app. The 14-day period includes the date of purchase, and receipts that are submitted more than 14 days after the date of purchase will not be accepted. The time of purchase will not be taken into consideration.
Mpoints earned on eligible spend at participating brands and available as Mpoints Balance will expire twenty-four (24) months from the date of issue. Your Mpoints will expire on the last day of every month, at 11.59 pm.
Mpoints cannot be earned on someone else’s transaction. For eligible outlets & website, Members can earn Mpoints for transactions made only by them.
In case of any of the programmes and offers running in parallel at any of the participating outlets including, but not limited to, external partner programmes, Members are only allowed to choose one of the programmes as a means to Earn Mpoints and use any Benefits or Rewards.
Mpoints will not be available for redemption before the transaction has been completed, paid for and the Mpoints have been added to the Member’s account.
Members cannot earn points on the payment for pre-discounted offer across all outlets including special promos or products that are part of a limited-time experience. In the chance that for certain packages Mpoints are offered on the eligible revenue, this is at the brand’s discretion and a member is not eligible for these points unless determined by the brand directly
Members will earn Mpoints on every Eligible Folio charged in United Arab Emirates Dirhams (AED) to an individual
Mpoints will be awarded against eligible transactions only after the transaction is paid for in full via channels accepted at the participating outlets and will be received in the member’s account within 24. Points cannot be used to adjust the total value of an invoice/bill against which it is accrued
Earning of Mpoints in fractions will not be available. Only the United Arab Emirates Dirhams (AED) amount before the decimal Point of the Eligible Spend value will be eligible for Mpoints earning on an item-by-item basis, i.e. if the price of an item is 24.99 AED, a member will earn 24 Mpoints.
To earn Mpoints, a Member must be a registered, paying Member of Motiv8.
Earning and redeeming Mpoints on consecutive bills is accepted.
A member’s monthly transaction history for up to a year is available online upon logging into the mobile application. Transactional history can be reviewed from mobile app by choosing a period of either 3, 6, 9 or a maximum of 12 months.
Motiv8 Mpoints earned by any individual Member are non-transferrable. Only one membership account is allowed per person as per the legal name.
If a Member believes they have not received the correct Mpoints credit(s) for any transaction, they must submit a request for such retroactive credit(s) by logging into the Motiv8 mobile application and providing the requested details. Member must quote their Membership number or registered mobile number on all retroactive claims. Failure to supply the adequate and unaltered documentation may result in denial of such Mpoints credit.
Motiv8 is designed for individual customers and does not currently offer corporate memberships. Member needs to be present in order to Earn or Redeem Mpoints.
It is the responsibility of the Member to remain updated about the Mpoints earning rates
YOUR AGREEMENT TO OUR USE OF INFORMATION ABOUT YOU
Motiv8 processes applicants’ personal information in accordance with Motiv8’s Privacy Policy (the “Privacy Policy”).
In addition, by participating in the Programme, Motiv8 may collect additional personal information from its applicants. Motiv8 may also use and share applicants’ personal information in the ways described below, in addition to what is described in the Privacy Policy. These Terms and Conditions supplement the Privacy Policy with respect to Motiv8’s processing of the personal information of its Members. If applicants do not agree to these terms, they must elect not to join the Motiv8 loyalty programme.
Additional personal information collected will include information that applicants or Members provide when they enrol in the Motiv8 loyalty programme or manage their profile online. During enrolment, Motiv8 requires applicants to provide their name, mobile number and e-mail address.
In addition to the uses and sharing described in the Privacy Policy, Motiv8 may use and share relevant portions of Members’ personal information in order to administer the Programme. This may include sharing personal information with Motiv8 Brands in order to credit Members with other Benefits earned through participation in the Motiv8 loyalty programme.
By enrolling, applicants also consent to the transfer of information to countries where Motiv8 or its Brands’ information processing facilities and business operations are located where data protection laws may differ from those of the applicant’s home country and / or the UAE.
To ensure that Members’ personal information is accurate and up-to-date, Motiv8 may also share Member information with a third party for the purpose of updating and enhancing the quality and content of the information it maintains.
Members may receive additional communications including Motiv8 account statements, offers specifically for Members and co-branded messages from Motiv8 Brand’s.
Motiv8 may modify these Terms and Conditions from time to time by posting the revised Terms and Conditions on the Programme Website. Motiv8 may also modify the Privacy Policy from time to time as described in the Privacy Policy. Members’ continued participation in the Motiv8 loyalty programme following the posting of changes to these Terms and Conditions or to the Privacy Policy, will indicate the acceptance of the changes.
CONDITIONS OF PARTICIPATION
Denaster provides Motiv8, these and other materials, and other services and products “as-is” and, to the fullest extent permitted by applicable law, expressly disclaims any warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, design, accuracy, capability, sufficiency, suitability, capacity, completeness or availability.
Members also agree that Motiv8 does not represent, warrant or guarantee that Motiv8 or any such other products and services will be uninterrupted, without omissions or error free, or that defects will be corrected or changes implemented.
Under no circumstances, including, but not limited to, negligence, shall Motiv8 be liable for any direct, indirect, incidental, special or consequential damages arising out of the programme or any such other products and services, even if an Motiv8 authorized representative has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to Members. In the event Motiv8 is held liable for any damages related to such matters, Members’ sole and exclusive remedy will be limited to reimbursement for services or products paid by the Member to the entity held liable which were not provided by such entity. Members hereby waive any and all rights to bring any claim or action related to such matters in any forum beyond two (2) years after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions, hereof, will remain in full force and effect. The failure by Motiv8 to exercise rights granted to Motiv8, hereunder, upon the occurrence of any of the contingencies set forth in this agreement will not constitute a waiver of such rights upon the recurrence of such contingency.
